These Terms and Conditions ("T&C") govern your use of the WorkforcePro.io platform ("Platform"), owned and operated by Apping Technology Sdn Bhd ("Company"), with a registered address at A4-8, Level 4, Block A, Plaza Dwitasik, Jalan 5/106, Bandar Sri Permaisuri, 56000 Kuala Lumpur, Malaysia. By accessing or using the Platform, you agree to abide by these T&C.
1.1 Acceptance of Terms
By registering on the Platform, you agree to these T&C. If you do not accept these terms, please refrain from using the Platform.
1.2 Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
1.3 Data Privacy & Confidentiality
All users must comply with our Privacy Policy, which governs the collection, processing, and storage of personal data. The data collected will be used solely for job matching and suggestion purposes. WorkforcePro.io complies with applicable data protection regulations, including the General Data Protection Regulation (GDPR), the Personal Data Protection Act (PDPA), and the California Consumer Privacy Act (CCPA), ensuring:
1.4 Intellectual Property Rights
The Platform and its content, including trademarks, software, and proprietary technology, remain the property of Apping Technology Sdn Bhd.
1.5 Limitation of Liability
Apping Technology Sdn Bhd is not responsible for any damages, including loss of employment opportunities, disputes between users, or indirect losses arising from Platform use.
1.6 Dispute Resolution
All disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be referred to arbitration under Malaysian law.
1.7 Governing Law
These T&C are governed by the laws of Malaysia.
1.8 Amendments to Terms & Conditions
Apping Technology Sdn Bhd reserves the right to amend or modify these Terms & Conditions at any time without prior notice. Continued use of the platform after any modifications shall constitute acceptance of the revised T&C.
2.1 Payment Terms
Hiring companies agree to pay a 10% service charge upon the successful placement of a candidate via the WorkforcePro.io platform. From this 10% service charge, revenue will be split among relevant stakeholders as outlined in Section 4.1.
2.2 Candidate Selection & Hiring Responsibilities
Employers are responsible for verifying candidate qualifications, credentials, and legal compliance before making hiring decisions.
2.3 3-Month Guarantee Period
If a hired candidate resigns or is terminated within three (3) months, the employer is entitled to a replacement candidate at no additional cost. No additional commission will be paid out for the replacement hire.
3.1 Profile Accuracy
Candidates must provide accurate information and update their profiles as needed.
3.2 Job Posting Rules
Applicants must comply with all job application guidelines and shall not submit fraudulent applications.
3.3 No Employment Guarantee
WorkforcePro.io does not guarantee employment or job placement.
3.4 Referral Bonus
To encourage job seekers to introduce and onboard more candidates to register on the platform, a referral bonus of 1% of the successfully placed candidate’s annual salary will be awarded to the referrer of the successful job seeker upon placement.
4.1 Revenue Sharing Model
The 10% service charge paid by hiring companies upon successful candidate placement will be distributed as follows:
4.2 Commission Payment Terms
Commission payouts to recruiters will only be made upon full payment from the hiring company.
4.3 Recruitment Ethics
Recruiters shall not misrepresent candidate qualifications or engage in unethical recruitment practices.
4.4 Non-Circumvention Clause
Gig recruiters shall not bypass WorkforcePro.io to directly place candidates with hiring companies without using the platform. If our algorithm captures job updates of candidates proposed to hiring companies following their posting, but the transaction did not go through via WorkforcePro.io, a penalty of 20% of the candidate’s annual salary will be claimed as compensation for breach of this clause.
4.5 Termination & Account Suspension
Apping Technology Sdn Bhd reserves the right to suspend or terminate a recruiter's account for non-compliance with these T&C.
